Question by Air Force Man: Can my mom force my 19yr old brother into rehab if he committed a crime against her?
Here is the situation, my brother has been into heavy drug use the last couple years. We have been trying to get help for him, but never had the money or ability to get him the help he needs. Also, he has flat out refused to go because he doesn’t feel he has a problem. We have tried interventions and showing how his actions impact us all, but he does not care. Now, while we were away, my brother entered our home and stole everything. Eventually, the police caught up with him. At that time, he was caught trying to swallow 2 grams of crack, but was prevented by the police. He also had a lot of items from our house in his possession. He was sent to the hospital, but was released into my mothers custody. An investigation is underway, but what is my moms best course of action from here? He has never wanted to go to rehab, but would she have the legal right to say something like; “I will only drop the charges of a what is being called a Class 3 felony if he completes a full year of in patient rehab?” Please help…thanks. This just happened two days ago, so we are waiting to hear more information from the police. Oh and we live in New Mexico if that makes any difference. Thanks for any advice you can provide.

The possesion charge for the crack isnt up to your mom to press or not to press. Thats a felony.
The thing she should not do is enable him any more in any way. He should still be sitting in jail right now. If he is in custody, he cant use. I’m surprised they released him to her. Your family should work with the DA to make sure these charges facilitate time away from drugs, and hopefully counseling.
